Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of foundr.video ("the Service"), operated by Nikola Innovations Limited. This AUP is incorporated into and forms part of our Terms of Service. Violation of this AUP may result in immediate suspension or termination of your account without refund.

1. Prohibited Content

You may not use the Service to create, distribute, or publish content that:

  • Impersonates others. Uses another person's name, likeness, voice, or brand identity without their explicit written consent. This includes creating avatars that resemble real people (other than yourself) without permission.
  • Is deceptive or fraudulent. Makes false claims about products, services, or businesses that you do not own or represent. The Service is designed to market YOUR product truthfully — not to create false advertising for others.
  • Contains hate speech or harassment. Targets individuals or groups based on race, ethnicity, gender, religion, sexual orientation, disability, or other protected characteristics.
  • Is sexually explicit or exploitative. Contains pornographic material, non-consensual intimate imagery, or sexualized content involving minors.
  • Promotes violence or terrorism. Incites, glorifies, or instructs violence against any person, group, or entity.
  • Infringes intellectual property. Uses copyrighted material, trademarks, or trade secrets belonging to third parties without authorization.
  • Violates applicable law. Is illegal in your jurisdiction or the jurisdiction where the content will be distributed.
  • Contains malware or phishing. Includes links, scripts, or calls to action designed to deceive users into providing credentials, downloading malware, or visiting harmful sites.

2. Prohibited Activities

You may not:

  • Create multiple accounts to exploit free trial credits, circumvent plan limits, or evade a previous account suspension.
  • Share, resell, or sublicense your account credentials or generated credits to third parties.
  • Use automated tools, bots, or scripts to interact with the Service in any way not expressly authorized by us.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service or its AI models.
  • Interfere with, disrupt, or overload the Service's infrastructure, including API rate limits and queue systems.
  • Probe, scan, or test the vulnerability of the Service or any related system without our written authorization.
  • Access other users' accounts, data, or generated content without authorization.
  • Use the Service to generate content that would be used for political misinformation, deepfakes intended to deceive, or synthetic media designed to manipulate public opinion.

3. Truth Sheet Accuracy

The Service generates content based on the Truth Sheet data you provide. You are responsible for ensuring that your Truth Sheet data is accurate, current, and not misleading. Deliberately providing false Truth Sheet data to generate misleading marketing content violates this AUP and may constitute false advertising under applicable law.

4. Enforcement

We reserve the right to investigate suspected violations of this AUP and to take any action we deem appropriate, including:

  • Issuing a warning.
  • Removing or disabling access to content that violates this AUP.
  • Suspending or terminating your account without refund.
  • Reporting illegal activity to law enforcement authorities.
  • Pursuing legal remedies, including seeking damages and injunctive relief.

6. Reporting Violations

If you believe a user of the Service has violated this AUP, please report it to support@foundr.video with a description of the violation and any supporting evidence. We review all reports and take appropriate action.
